fps in transcode: where are the limits?

hi,

i have a "stream" from a video-capture-device with 50 FPS.

I want to stream it with very low Framerate ... but I tried values between 2 and 10 FPS in transcodeoptions, the client ( WMPlayer) always show me rates over 8 FPS.
WHY?
I need it to keep cpu-load low - because i need a strong compression to 128 - 256 Kbps

are there other ideas to keep cpuload down or to compress the video without a cpu-load of 100%? ?
